Social media, from law firm websites to online networking, has become both a preferred means of communication and an important marketing tool for lawyers and firms. But ethical traps abound for lawyers who use these tools to communicate with clients, potential clients, and even friends and family. State bar discipline, compromised cases and malpractice exposure, even job loss, has resulted from ill-advised use of social media by lawyers. Worse, courts, state bar associations and disciplinary counsel have offered scant guidance on potential ethical violations arising from use of social media. Do the print advertising rules apply or does something new? Is blogging subject to a different standard, such as political speech? Make sure you know how to navigate the waters of social media ethically from an informative presentation with many real world examples.
